Terms of Service

Acceptance and eligibility

You must be at least the age of majority in your province and able to enter a binding contract to use the Service. If you use it on behalf of a business, you confirm you are authorized to bind that business to these Terms. If you do not agree, do not use the Service.

What HomeCopilot is

HomeCopilot is a planning tool and a marketplace. We help you describe and plan a home project and, when you ask, connect you with independent professionals. We are not a contractor, and we do not perform, supervise, guarantee, or take responsibility for the work professionals do. Any agreement for services is directly between you and the professional. We do not guarantee that a suitable professional is available in your area or that any particular outcome, price, or timeline will result.

Your account

• Provide accurate information and keep it up to date.
• Keep your credentials secure; you are responsible for activity under your account.
• Tell us promptly of any unauthorized use.
• One business should not register duplicate accounts of the same type; the same business may hold different account types (for example, contractor and supplier).

The AI planner — what it is and isn’t

The AI planner produces ranges, observations, and suggestions to help you plan. It does not provide a quote, a binding price, or a completion date, and it is not professional, engineering, legal, or safety advice. It does not, and cannot, diagnose concealed structural, electrical, gas, mould, or other hazardous conditions from a photo or description. Concealed conditions can materially change scope and price. A qualified professional must confirm the real scope, price, and feasibility before you rely on them. For emergencies or suspected hazards, contact the appropriate professional or emergency service.

Matching and the marketplace

When you ask to be matched, we share your project brief with the professional(s) you approve. Matching is based on factors such as category fit, service area, verification status, and performance — it is not simply sold to the highest bidder, and any commercial placement is identified as such. You are told whether one or more professionals will contact you. You are free to choose whether, and with whom, to proceed.

Terms for professionals

If you use the Service as a contractor, supplier, or partner, you also agree that you will:

• Provide accurate business, licensing, and insurance information, and keep verification current where required.
• Hold the licences, permits, and insurance the law requires for the work you perform.
• Respond to homeowners professionally and honestly, and not misrepresent credentials, reviews, or availability.
• Use homeowner information only to respond to and deliver the requested work, consistent with our Privacy Policy and applicable law.
• Pay any applicable subscription or lead fees under the plan you select; fees and any lead credits are described at the point of purchase.

Reviews and portfolio content must be genuine. We may verify, moderate, suspend, or remove listings and accounts that violate these Terms or harm the trust of the marketplace.

Your content and consent

You keep ownership of the content you submit — project descriptions, photos, messages, and documents. You grant HomeCopilot a licence to host, process, and display that content as needed to operate the Service for you (for example, to build your brief and share it with a professional you choose). We use completed-project photos or details for marketing, portfolio, or case-study purposes only with the relevant party’s consent. You are responsible for having the rights to the content you upload and for not submitting anything unlawful or infringing.

Fees and payments

Planning with the AI is free. Some professional features and marketplace services are paid. Prices, billing cycles, and any taxes are shown before you buy. Payments are processed by our payment provider (Stripe); by paying, you also agree to their terms. Except where required by law or expressly stated, fees are non-refundable; disputed charges and lead disputes are handled through our support and dispute process.

Acceptable use

You agree not to:

• Break the law, infringe others’ rights, or submit false, deceptive, or harmful content.
• Post fake reviews, misrepresent identity or credentials, or manipulate matching.
• Scrape, harvest, or bulk-extract data, or probe, disrupt, or overload the Service.
• Upload malware, attempt unauthorized access, or circumvent security or tenant boundaries.
• Use the Service to send unlawful marketing or to harass others.

Third-party services

The Service integrates with third parties (for example, payment, messaging, mapping, and analytics providers) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is governed by their own terms and privacy practices.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that estimates, matches, or professionals will meet your expectations. Nothing in these Terms limits rights you have under applicable consumer-protection law that cannot be waived.

Limitation of liability

To the fullest extent permitted by law, HomeCopilot is not liable for indirect, incidental, special, consequential, or punitive damages, or for the acts, omissions, work, or agreements of any professional or other user. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or CAD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold HomeCopilot harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your dealings with another user or professional.

Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts located in Ontario have jurisdiction over disputes, subject to any mandatory rights you have under applicable law. We encourage you to contact us first so we can try to resolve any concern.

Changes to these terms

We may update these Terms as the Service and the law evolve. We will change the “last updated” date above and, for material changes, provide additional notice. Your acceptance is recorded against the version active at the time, and continued use after an update means you accept the revised Terms.
